These Terms of Service ("Terms") govern your access to and use of the NightShadow game, the Zon Productions website and download portal, the NightShadow launcher, and any related services (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. CLOSED_ALPHA_STATUS

NightShadow is in closed alpha. Access is an invitation-only, revocable privilege — not a purchase and not a right. You acknowledge that:

• The game is unfinished. Features may change, break, or disappear without notice.
• Progress, statistics, accounts, and any other data may be reset or wiped at any time.
• The Services may be unavailable, interrupted, or discontinued at any time.
• You may not share, redistribute, sell, or re-host the game client, launcher, or any game files.
• You may not publicly share builds, footage, screenshots, or details of the game without prior written permission from Zon Productions.

2. ELIGIBILITY

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may only use the Services with the consent of a parent or legal guardian who agrees to these Terms on your behalf. We may refuse, suspend, or revoke access to anyone at our discretion.

3. YOUR_ACCOUNT

• Provide accurate registration information and keep it current.
• One account per person. Do not create additional accounts, including to evade a ban.
• Keep your password secret. You are responsible for all activity on your account.
• Do not share, sell, transfer, or give away your account or access credentials.
• Accounts are manually approved. Registration alone does not guarantee access.
• Notify us immediately if you believe your account has been compromised.

4. CODE_OF_CONDUCT

While using the Services, you agree that you will not:

• Use cheats, hacks, aimbots, wallhacks, macros, bots, scripts, or any unauthorized third-party software that provides a competitive advantage or automates gameplay.
• Exploit bugs, glitches, or design oversights for gain. Found one? Report it — abusing it is a bannable offense.
• Reverse engineer, decompile, modify, or tamper with the game client, launcher, or servers.
• Attack, disrupt, or overload the Services or other players' connections (including DoS/DDoS or traffic manipulation).
• Harass, threaten, or abuse other players. No hate speech, slurs, doxxing, or discriminatory conduct of any kind.
• Impersonate other players, Zon Productions staff, or anyone else.
• Use offensive, misleading, or infringing usernames.
• Use the Services for any commercial purpose, or for anything illegal.

Play hard, play fair, don't be toxic. We are a small community and we intend to keep it a good one.

5. INTELLECTUAL_PROPERTY

The Services — including the game, all game content, software, art, audio, names, and branding — are owned by Zon Productions and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for private, non-commercial play in accordance with these Terms. No other rights are granted.

If you send us feedback, suggestions, or ideas about the Services, you grant Zon Productions a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. (It's an alpha — feedback is the whole point.)

6. ENFORCEMENT

We may investigate violations and take any action we consider appropriate, including warnings, temporary suspension, permanent account bans, IP bans, and removal of content — with or without notice, at our sole discretion. Cheating or harassment will typically result in an immediate permanent ban.

7. TERMINATION

You may stop using the Services and request deletion of your account at any time by contacting us. We may suspend or terminate your access at any time, for any reason, including the end of the alpha program. Sections 5, 8, 9, and 10 survive termination.

8. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL BE PRESERVED.

9. LIMITATION_OF_LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZON PRODUCTIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE PAST TWELVE MONTHS — WHICH, FOR THE CLOSED ALPHA, IS ZERO.

10. GOVERNING_LAW

These Terms are governed by the laws of the United States and the state in which Zon Productions operates, without regard to conflict-of-law rules. Before filing any dispute, you agree to contact us first and attempt to resolve it informally.

11. CHANGES_TO_THESE_TERMS

We may update these Terms from time to time. The "Last updated" date above will change when we do, and material changes will be announced on the site or in our Discord. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
